FLEXY RIDE
TERMS & CONDITIONS
These Terms apply to child transport services provided by Flexy Ride Ltd (“Flexy Ride”). By accepting a transport plan, booking, paying for or using the service, the Parent/Guardian agrees to these Terms and the agreed transport plan.
1. SERVICE
Flexy Ride provides shared, door-to-door child transport based on the agreed locations, days and approximate times. Services are subject to availability, route feasibility, traffic and safe operating conditions.
2. AGREED TRANSPORT PLAN
The agreed plan sets out the pickup/drop-off locations, days and approximate times. Customer-requested changes apply only once confirmed by Flexy Ride. Flexy Ride may reasonably adjust routes, times or arrangements for operational or safety reasons.
3. CHILDREN AGED 6–11
For children under 12, handover is required at pickup and drop-off, unless otherwise agreed in writing.
At pickup, the child must be handed directly to the Flexy Ride staff member responsible for children onboard, whether collected from home, school, an activity or another agreed location. At drop-off, the child will be handed to the Parent/Guardian or an authorised person. The child may be left without someone present only with prior written consent from the Parent/Guardian. If nobody is available and no such consent has been provided, Flexy Ride will not leave the child unattended and will contact the Parent/Guardian or authorised contact.
4. CHILDREN AGED 12+
For children aged 12 or older, unless a different arrangement has been expressly agreed, Flexy Ride's responsibility for the journey ends when the child safely exits the vehicle at the agreed destination. An adult handover is therefore not required for children aged 12 or older.
5. PARENT/GUARDIAN RESPONSIBILITIES
Parents must provide accurate contact, pickup/drop-off and safety-related information, including information required for appropriate child restraints. Children must be ready at the agreed or most recently notified pickup time. Flexy Ride may wait up to 3 minutes, where operationally possible. After this, the vehicle may leave and the journey may be charged as a no-show.
6. SAFETY & BEHAVIOUR
Children must follow reasonable safety instructions, wear required restraints and behave appropriately. Flexy Ride may refuse, suspend or discontinue transport where a child's behaviour creates a safety risk or seriously disrupts the service.
7. TIMES & DELAYS
Pickup and arrival times are estimates. Traffic, previous stops, road conditions, accidents, weather and other circumstances may cause delays. Flexy Ride will make reasonable efforts to communicate significant delays.
8. PRICING & PAYMENT
The agreed price is based on the child's agreed transport plan and the total applicable school days across the service period. For recurring services, the total cost is calculated taking into account school days, scheduled school holidays and public holidays, and is then divided into an average monthly subscription amount. Therefore, the monthly price remains the same even when one month has fewer school days than another. Payment is made in advance, normally no later than one week before the relevant service period. Flexy Ride may suspend the service for overdue payments.
9. CUSTOMER CANCELLATION
For individual journeys:
24+ hours' notice: Flexy Ride may provide a credit.
Less than 24 hours' notice or no-show: The journey is charged.
For recurring services, cancellation normally takes effect at the end of the current paid period. Amounts already paid are not automatically refundable solely because the Parent/Guardian chooses to stop the service, subject to applicable law.
10. CHANGES OR CANCELLATION BY FLEXY RIDE
Flexy Ride may change, suspend or discontinue a journey or route for safety, breakdown, driver availability, changes in demand, route feasibility or other reasonable operational reasons. Where possible, reasonable notice will be given. If Flexy Ride permanently cancels prepaid transportation that will not be provided, the unused amount will be credited or refunded as applicable.
11. NOTIFICATIONS & JOURNEY INFORMATION
Flexy Ride may send journey notifications, including pickup, arrival, collection and drop-off information.
Any tracking provided is for the relevant child's journey and must not be used to access or share information concerning other children.
12. LIABILITY
Flexy Ride will provide its services with reasonable care and in accordance with applicable legal and regulatory requirements. Flexy Ride is not responsible for losses resulting solely from circumstances outside its reasonable control, including exceptional traffic, road closures, accidents, weather or other external events. To the extent permitted by law, Flexy Ride is not responsible for indirect or consequential losses arising from delays, changes to estimated journey times or service disruption. Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.
13. PERSONAL DATA
Flexy Ride processes personal information only as reasonably necessary to provide and administer the service, communicate with Parents/Guardians, manage payments and meet legal or safety requirements.
14. COMPLAINTS & REFUND RIGHTS
Parents should promptly contact Flexy Ride regarding any service concern. Nothing in these Terms limits mandatory consumer or refund rights under applicable Cyprus law.
15. CHANGES TO THE TERMS
Flexy Ride may update these Terms for reasonable operational, regulatory or legal reasons. Material changes affecting an existing service will be communicated appropriately.
16. GOVERNING LAW
These Terms & Conditions are governed by the laws of the Republic of Cyprus.
ACCEPTANCE The Parent/Guardian may accept these Terms electronically, including through WhatsApp or other written electronic communication. Flexy Ride may retain evidence of the acceptance and the version accepted.
